End-User License Agreement

(EULA)

This End-User License Agreement (“Agreement”) is a legally binding agreement between you (“Customer” or “You”) and Henning Hein – Traces On Tape (“Traces On Tape”).

By downloading, accessing, or using any sound effects, audio files, impulse responses, recordings, metadata, or related content provided by Traces On Tape (collectively, the “Content”), You agree to be bound by this Agreement.

  1. License Grant

Subject to full payment and compliance with this Agreement, Traces On Tape grants You a non-exclusive, non-transferable, non-sublicensable license to use the Content as incorporated into your own creative works and productions (“Projects”).

Permitted uses include:

synchronization with audiovisual works
use in films, games, music, trailers, broadcasts, podcasts, and interactive media
commercial and non-commercial productions
public performance, streaming, and broadcasting of finalized Projects

The license is granted to one individual user only.

You may deliver finalized Projects containing the Content to clients, distributors, broadcasters, or publishers, provided the Content cannot be extracted, reused, or accessed as standalone files.

  1. Single-User License

Each purchased license is valid for one natural person only.

The raw Content may not be shared with collaborators, employees, contractors, studios, servers, cloud libraries, or other users unless an appropriate multi-user license has been obtained.

  1. Restrictions

Except where explicitly permitted, You may not:

resell, sublicense, redistribute, share, upload, or otherwise distribute the Content, in whole or in part
make the Content available as standalone files
include the Content in any competing sound library, sample pack, preset collection, virtual instrument, convolution reverb library, training dataset, or similar product
use the Content for training, fine-tuning, developing, validating, or improving any artificial intelligence, machine learning, neural network, generative audio, or dataset system
embed the Content in any application, software, plugin, game engine, SaaS platform, or hardware product where end users can access, extract, manipulate, or reuse the Content independently
claim authorship, ownership, or copyright in the original Content

The Content must always form part of a larger original Project.

  1. Ownership

All Content remains the intellectual property of Traces On Tape.

No ownership rights are transferred to You under this Agreement.

All rights not expressly granted are reserved.

  1. Warranty Disclaimer

Traces On Tape warrants that it has the authority to license the Content.

Except for the foregoing, the Content is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement.

  1. Limitation of Liability

To the maximum extent permitted by law, Traces On Tape shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, business opportunities, or data arising from the use or inability to use the Content.

  1. Refund Policy

Due to the digital nature of the products, all sales are final.

By purchasing and initiating the download process, You expressly consent to the immediate performance of the contract and acknowledge that your statutory right of withdrawal under applicable consumer protection law may expire once the download begins.

  1. Termination

This Agreement terminates automatically if You materially breach any provision of this Agreement.

Upon termination:

all granted rights immediately cease
You must permanently delete all copies of the raw Content from all storage systems and backups
You must cease any further use of the Content

Completed Projects finalized before termination may continue to be exploited, provided they otherwise comply with this Agreement.

  1. Governing Law

This Agreement shall be governed by the laws of the Federal Republic of Germany.

Where legally permissible, the place of jurisdiction shall be Cologne, Germany.

Mandatory consumer protection provisions of the country in which You reside remain unaffected.

  1. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
